The government of Tritikona shall be a republic consisting of three branches: the Executive Branch, the Legislative Branch, and the Judicial Branch.

Each branch shall be separate and distinct, with checks and balances to prevent the abuse of power, ensuring that the dignity and rights of all people are protected.

Threats of, or incitement to, death, violence, or insurrection, shall be illegal, regardless of motivation or intention to execute. Charges may be pressed by those against whom such words are directed. It is that person’s right not to press charges against the violator. Penalty for such behavior shall be determined by the courts. Violation of this act is an impeachable offense; however, this shall not be so construed as to incriminate persons ex post facto.

I. Powers of the Government and the Election Process

The Executive Branch

The President

The President shall be the head of state and the chief executive officer of Tritikona. His term of office shall be 10 days, with no President allowed to serve consecutive terms. A President may serve unlimited non-consecutive terms.

Presidential candidates will only (in most cases) be Senators. Presidential candidates must be selected by the Senate parties 5 days before the election. A Senator may run as an Independent on the ballot but must obtain 4 or more signatures to do so. When the candidates are decided, they will choose their running mates, whether that be another senator or a citizen.

When everything is settled, Senate parties will appoint replacements to the empty seats. If an Independent runs for President, the sitting VP will choose a replacement to finish out the incumbent's term.

Citizens and Independent Senators may run for President but need a minimum of four signatures to appear on the ballot. The number of candidates running for President shall be limited to no more than three.

If 2 party Senators are already running and and Independent and/or a Citizen wishes to run, the candidate with the most signatures by the end of a certain date will appear on the ballot.

If there is a 2-2-2-2 split in the senate, the incumbent party will automatically appear on the ballot. The rest of the Senate not comprised of the incumbent party will then convene to decide a second candidate. If no second candidate is chosen, the candidate with the most signatures will appear on the ballot.

In the event of a tie in a Presidential election, the new Senate will convene and vote to decide the winner.

The President shall lead the nation in accordance with Christian values and shall take an oath to uphold and protect the Constitution of Tritikona.

The President may issue Executive Orders, but each Executive Order must specify the law it enforces before it takes effect. These Orders must align with the principles outlined in our Constitution and Bill of Rights.

The Vice President

The Vice President shall serve as the President of the Senate and shall have a 10-day term, with no consecutive terms allowed.

The Vice President shall have a tiebreaking vote in the Senate and shall be selected by the President as his running mate.

The Vice President may be an ordinary citizen of Tritikona and not necessarily a member of the Senate.

Powers of the President and Vice President

The President shall have the authority to appoint Supreme Court Justices, issue Executive Orders in line with the common good and most importantly serve as the Commander in Chief of Tritikona's armed forces.

The Vice President is first in the line of succession to the presidency in the event that the sitting President is removed from office or dies during his term. The Vice President has the power to solely present bills to the Senate for discussion and a vote.

The President may veto any bill passed by the Senate. A 2/3 majority vote in the Senate is required to override the veto.

The President may propose amendments to the Constitution, but such amendments shall be brought before the Senate and the people for approval. For an amendment to pass, 2/3 of the Senate is needed to pass and 2/3 of the population is needed to ratify.

If the Senate has 2 signatures or more, they may propose their own amendment on the floor for a discussion and vote.

The Legislative Branch

The Senate

The Senate shall consist of 8 members, two from each of the four districts of Tritikona

Senators shall serve a 10-day term. Unlike the President and Vice President, Senators may serve consecutive terms.

In the event of a tie in a Senate race, the newly elected Vice President will be given a tie breaking vote to decide the winner.

Senate candidates shall be nominated by their party members 5 days before the election. The Senate shall vote on bills proposed by the Vice President and passed through committee.

The minority party may present bills if they receive 2 or more signatures. Only the VP may solely present bills to the Senate.

Powers of the Senate

The Senate of Tritikona is granted specific powers to govern and manage the country’s affairs.

The Senate has the authority to impose taxes on citizens and businesses, regulate the economy, and manage national financial policies. It also has the power to establish a national currency and regulate trade, including setting tariffs and controlling imports and exports.

The Senate holds the power to authorize military spending, raise and maintain armed forces, and make decisions on national defense. This includes approving declarations of war and crafting policies to protect the nation’s security.

The Senate is empowered to create, amend, and pass laws on various matters, including criminal justice, civil rights, and the overall governance of the nation. This includes the power to create laws for the general welfare and for maintaining public order.

The Senate is responsible for authorizing and funding the construction of public infrastructure projects, such as roads, bridges, utilities, and transportation networks. These projects aim to promote economic development and improve the quality of life for the citizens of Tritikona.

The Senate has the authority to set policies for naturalization and immigration. This includes regulating who can become a citizen and setting guidelines for the admission of foreigners into the country.

The Senate has the power to review, amend, and ratify treaties with other nations. It ensures that any agreements with foreign governments are in the best interest of Tritikona and its people.

In times of national emergency or crisis, the Senate can enact temporary measures to address immediate threats to the nation. These actions must be limited in scope and duration, and they are subject to review once the emergency is resolved.

Limitations on the Powers of the Senate of Tritikona

While the Senate holds significant powers, these are subject to certain limitations designed to preserve the rights of the people and prevent the abuse of authority:

The Senate cannot pass any laws that violate the fundamental rights of the citizens of Tritikona. All legislative actions must respect the rights enshrined in the Constitution, ensuring that individual freedoms, such as the freedom of speech, religion, and privacy, are upheld.

The Senate cannot suspend the writ of habeas corpus, which guarantees that citizens will not be unlawfully detained, except in cases of rebellion or invasion where public safety requires it. Even in such cases, any suspension must be temporary and justifiable.

The Senate is prohibited from passing laws that make an action illegal after it has been committed. This means that the Senate cannot pass retroactive laws that punish acts that were legal when they occurred.

The Senate cannot create or grant titles of nobility, aristocratic privileges, or any other forms of hereditary status. All citizens are considered equal before the law, and no one can claim special privileges based on family lineage or social class.

The Senate must ensure that all taxes are fair and distributed equitably across the population. Direct taxes must be apportioned based on population, and any tax legislation must be transparent and open to public scrutiny.

The Senate is prohibited from accepting gifts, bribes, or any form of compensation from foreign governments, corporations, or other entities that could influence its decisions. All interactions with foreign powers must prioritize the national interest of Tritikona.

The Senate cannot assume powers that belong to the Executive or the Judiciary. Each branch of government must function independently, and no branch can interfere with or override the actions of the others, ensuring a balance of power.

Election of Senators

Each party may nominate candidates to run in districts held by opposing parties, as long as the candidate is a resident of the district in which they are running.

Just like Presidential elections, Senate elections shall be held every 10 days, and absentee ballots may be requested for those unable to attend in person.

Impeachment and Expulsion

The Senate shall have the authority to impeach the President, Vice President, or Supreme Court Justices for acts of misconduct. A majority vote in the Senate is required to begin impeachment proceedings.

The Senate shall not vote on removal from office until they have heard both the prosecution and the defense. In impeachment trials, a special prosecutor shall be appointed by the Senate. After testimony the motion will go to a vote.

A 2/3 majority vote is required to remove any official from office. Senators may also expel members who have committed wrongdoings. Expelled Senators shall be prohibited from holding any Senate seat in the future or serving as a Supreme Court Justice.

The Judicial Branch

The Supreme Court

The Supreme Court shall consist of 3 Justices appointed by the President. The term of each Justice shall last 20 days or two Presidential terms.

At the end of their term, each Justice shall be subject to a public vote to decide whether they should remain in office. If a Justice is not retained, the new President shall appoint a replacement(s).

In the event of a tie in a Supreme Court election, the Justice would retain his seat.

Sitting Supreme Court Justices may not vote in elections. Violation of this rule would result in removal from the court and possible jail time.

The Supreme Court shall have the authority to interpret the laws of Tritikona, ensuring that they align with the Constitution and the Bill of Rights.

Duty of The Court

The Bible, and the moral precepts contained therein, shall be the highest law and constitution of the land. All other laws, executive actions, decisions of the court, officials and citizens of the land shall be bound thereby. Justices are to strike down laws which contradict it, and officials, representatives, and justices who do not to the best of their ability enforce it, shall be impeached and removed.

The unenumerated, or common, law of Tritikona shall be regarded as authoritative, but subordinate to the enumerated legislation of the Senate. When a dispute shall come to the courts, which pertains to the common law, then the justices shall rule according to their best interpretation; but they shall make an earnest appeal to the Senate to make a bill which either codifies or dissolves the common law on which the case was judged. Executive orders of the President may be struck down by the court based on a common law, but the Senate shall have power by a majority vote to uphold the executive order.

Impeachment of Justices

A Justice may be impeached for serious misconduct or failure to uphold the law. The Senate shall hold impeachment proceedings, and a 2/3 majority vote is required for removal. A removed Justice may never return to the Supreme Court but may run for Senate or the Presidency.

II. Relationships Between the Districts

Each district of the Republic of Tritikona shall recognize and uphold the legal decisions, records, and official actions made by the government, in matters not prohibited by the Constitution. Laws that are passed shall be honored, provided they do not conflict with the rights guaranteed to all citizens by this Constitution.

All citizens of the Republic, regardless of the district in which they reside, shall be entitled to the same rights and privileges, including but not limited to access to public services, property rights, and legal protections. No district shall discriminate against the citizens of other districts, and no laws shall restrict the movement or employment of citizens across district borders, except where necessary for public safety.

The creation of new districts within the Republic may occur through legislation passed by the Senate, provided such formation respects the boundaries and self-determination of existing districts. The government shall provide for the orderly establishment of any new districts, which shall be subject to the same rights and responsibilities as existing districts.

All districts are required to cooperate with the government in national matters such as defense, infrastructure, and foreign relations. Each district is entitled to fair representation in the Senate, and the central government shall consult with the Senators when considering legislation that impacts local governance, economic development, or regional interests.
